By accessing or using AIverse ("Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, you may not access the Service.

AIverse is a decentralized marketplace for intelligent Non-Fungible Tokens ("iNFTs") that enables users to mint, trade, and collect tokenized AI agents.

2.1 Platform Overview

AIverse is a marketplace platform that facilitates:

Creation and minting of iNFTs containing AI agents

Trading and exchange of iNFTs between users

Collection management and organization of iNFT assets

Access to AI agent functionalities embedded within iNFTs

2.2 Beta Mainnet Release

AIverse is currently operating in beta mainnet release. This means:

The platform is now available to all users for testing and use

All transactions involve real cryptocurrency and have real monetary value

The platform may experience instability, bugs, or unexpected behavior

Smart contracts and platform features are still being tested and refined

Users should exercise extreme caution and only risk funds they can afford to lose

2.3 Blockchain Integration

Our platform operates on blockchain networks and integrates with various protocols. All transactions are recorded on-chain and are generally irreversible.

3.1 Age Requirements

You must be at least 18 years old to use AIverse. By using our Service, you represent and warrant that you meet this age requirement.

3.2 Wallet Connection

To use AIverse, you must connect a compatible cryptocurrency wallet. You are responsible for:

Securing your wallet and private keys

All transactions made through your connected wallet

Any fees associated with blockchain transactions

3.3 Prohibited Jurisdictions

AIverse is not available to users in any Office of Foreign Assets Control (OFAC) (OFAC) sanctioned countries or jurisdictions where cryptocurrency trading or NFT transactions are prohibited by law.

4.1 User-Generated Content

When you create or mint iNFTs on AIverse:

You retain ownership of original content you create.

You grant AIverse a perpetual non-exclusive license to display, distribute, and promote your content.

You warrant that you have all necessary rights to the content.

You are responsible for ensuring your content doesn't infringe third-party rights.

4.2 AI Agent Content

You acknowledge that:

AI agents may generate unpredictable content.

We are not responsible for content generated by AI agents.

You use AI agent outputs at your own risk.

Generated content may not be suitable for all purposes.

4.3 Platform Content

AIverse retains all rights to:

Platform design, code, and functionality.

AIverse branding and trademarks.

Platform-generated analytics and insights.

5.1 Transaction Finality

All blockchain transactions are final and irreversible. We cannot reverse, cancel, or refund completed transactions.

5.2 Gas Fees and Costs

You are responsible for all blockchain transaction fees ("gas fees") and any other costs associated with using the platform.

5.3 Pricing and Payments

Sellers set their own prices for iNFTs.

We may charge platform fees on transactions.

All payments are processed through smart contracts.

We do not hold custody of funds or NFTs.

5.4 Trading Restrictions

We reserve the right to restrict or revoke trading of iNFTs that:

Violate these Terms.

Contain illegal or harmful content.

Infringe intellectual property rights.

Pose security or safety risks.

6.1 Agent Functionality

iNFTs may contain AI agents with various capabilities.

Agent performance and availability are not guaranteed.

We are not responsible for agent malfunctions or downtime.

Agent responses do not constitute professional advice.

6.2 Private vs Public iNFTs

Public iNFTs have openly readable metadata.

Private iNFTs contain encrypted metadata accessible only to owners.

You choose the privacy level when creating iNFTs.

6.3 Metadata Updates

iNFT metadata may be updated according to the ERC-7857 standard.

Updates require owner authorization.

We provide interfaces to facilitate legitimate updates.

You may not use AIverse to:

Create, trade, or promote illegal content.

Infringe intellectual property rights.

Engage in market manipulation or fraud.

Create agents that spread misinformation or harmful content.

Violate any applicable laws or regulations.

Circumvent platform security measures.

Create agents designed to harm others or access unauthorized systems.

8.1 Data Collection

We collect minimal data necessary to operate the platform:

Wallet addresses and transaction history.

Usage analytics and performance metrics.

Support communications.

8.2 Blockchain Transparency

Remember that blockchain transactions are public. While we protect your personal information, your trading activity may be visible on-chain.

8.3 AI Agent Data

Private iNFT data is encrypted and not accessible to us

Public iNFT data may be indexed for platform functionality

We do not train models on your private agent configurations

9.1 Beta Platform Risks

IMPORTANT: AIverse is currently in beta mainnet release. By using the platform, you acknowledge and accept the following risks:

Smart contracts may contain bugs or vulnerabilities

Platform functionality may be unstable or unreliable

Features may change without notice

Data loss or corruption may occur

Transactions may fail or behave unexpectedly

You may lose all funds deposited or used on the platform

9.2 Service Availability

AIverse is provided "as is" without warranties. We do not guarantee:

Continuous platform availability.

Error-free operation.

Compatibility with all devices or wallets.

Performance of AI agents.

9.3 Trading Disclaimer

iNFTs are experimental digital assets, which are consumer goods and not financial products or securities.

Values may fluctuate significantly or become worthless within the trading platform.

This is not investment advice.

Trade at your own risk.

9.4 AI Technology Limitations

Private iNFT data is encrypted and not accessible to us

Public iNFT data may be indexed for platform functionality

We do not train models on your private agent configurations

To the maximum extent permitted by law:

We are not liable for any indirect, incidental, or consequential damages.

Our total liability is limited to the lesser of $100 or the amount you paid in the 12 months prior to the claim.

We are not responsible for losses due to market volatility, technical failures, or user error.

We are not liable for any losses resulting from the beta nature of the platform

You agree to indemnify and hold harmless AIverse (and any persons employed or affiliated with it) from any claims, damages, or expenses arising from:

Your use of the platform.

Your iNFT creations or trading activities.

Your violation of these Terms.

Your infringement of any type of third-party rights.

12.1 Service Modifications

We may modify, suspend, or discontinue features at any time. During testnet, changes may occur without prior notice.

12.2 Terms Updates

We may update these Terms periodically. Continued use constitutes acceptance of updated Terms.

13.1 Account Termination

We may suspend or terminate your access for violations of these Terms. You may stop using the platform at any time.

13.2 Effect of Termination

Your iNFTs remain on the blockchain regardless of account status.

You retain ownership of minted assets. You will be able to move your minted assets to a wallet of your choosing via sale to this wallet.

Platform access and services may be discontinued.

14.1 Governing Law

These Terms are governed by BVI law, without regard to conflict of law principles.

14.2 Arbitration

Disputes will be resolved through binding arbitration rather than court proceedings, except for claims that may be brought in small claims court.

15.1 Entire Agreement

These Terms constitute the entire agreement between you and AIverse regarding the Service.

15.2 Severability

If any provision is found invalid, the remaining provisions will continue in full force.

By using AIverse during the beta mainnet phase, you explicitly acknowledge and agree that:

Real Value at Risk: All transactions involve real cryptocurrency with real monetary value

Platform Instability: The platform is not stable and may experience significant issues

Smart Contract Risks: Smart contracts are experimental and may contain vulnerabilities

Total Loss Possible: You may lose all funds used on the platform

Use at Your Own Risk: You assume all risks associated with using beta software

No Guarantees: We provide no guarantees regarding platform performance or security

Cautious Approach Required: You should only risk funds you can afford to lose completely
